Mobile Messaging Terms and Conditions

CoinCache LLC (“CoinCache”) offers recurring and occasional one-time or limited-duration text message programs. These Mobile Messaging Terms and Conditions (“Text Terms”) govern these text message programs, unless a specific set of additional terms are provided.

By signing up to participate in our text message programs, you agree to these Text Terms as well as CoinCache’s Terms of Service, which are incorporated and considered a part of these Text Terms and grant us certain rights and licenses, provide us certain indemnities, waive certain of your rights and remedies, and limit our liability and obligations to you. In addition, as set forth in our Terms of Service, any dispute, controversy, or claim between the parties arising out of or relating in any way to these Text Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, or arising out of or related to your use of the CoinCache Services, shall be determined by arbitration in Alabama before one arbitrator. The arbitration shall be administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures. Judgment on the Award may be entered in any court having jurisdiction. This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction.. CoinCache will use information collected from you in accordance with the CoinCache Privacy Policy. To the extent of any inconsistencies, the Text Terms in this document will apply to our text message programs.

Essential Messages

​

When you use CoinCache Services, you may be required to receive SMS messages for identity verification and notification purposes (“Essential Messages”). Because these messages are a required part of providing the Services to you, you cannot opt out of receiving them.

 

Optional Messages

​

When you use other CoinCache Services, you may have the option to sign up to receive SMS messages for informational, marketing, and other purposes (“Optional Messages”). ​ When you agree to participate in our Optional Messages program(s), you typically agree to receive recurring automated, text (e.g., SMS, MMS, and RCS) messages from CoinCache, such as information about the service and your transaction, account alerts, receipts, follow ups (e.g. requesting feedback on your experience), personalized special offers, rewards, deals, updates, reminders, and other transactional and/or promotional marketing texts. We may send reminders based on your transactions or your activity on our website or at the kiosks, such as abandoned cart reminders, browse abandonment, and post purchase follow-ups (e.g. receipts or offers based on your prior transactions, survey, or sweepstakes opportunities), which may be based on your use of cookies or other tracking technologies when you view content on the website or app. When you opt-in to receive Optional Messages from CoinCache, you are expressly giving consent to CoinCache to contact you at the mobile telephone number you provided when signing up or any other number that you designate.

Message frequency may vary. CoinCache reserves the right to alter the frequency of messages sent at any time, such as to increase or decrease the total number of sent messages. Messages may be sent using an automatic telephone dialing system, artificial, or pre-recorded voice. Your consent to receive such text messages is not a condition of any purchase.

To opt-in to participate in CoinCache Optional Message(s) program(s), you will need to follow the instructions provided by CoinCache for that text message program, which may include inputting your phone number in our kiosks, texting a message to a short code, filling out a form, providing your phone number while on a call with us, or otherwise signing up and providing your consent. You may need to confirm your consent, such as by replying Y (or other designated response) to an initial text message sent to you.

CoinCache reserves the right to change the short code or phone number from which messages are sent, and you consent to receive messages from the new short code or number upon notice from us of the new short code/number.

Not all mobile devices or handsets may be supported and our messages may not be deliverable in all areas. CoinCache, its service providers and the mobile carriers supported by the program are not liable for delayed or undelivered messages. You understand and acknowledge that network services, including but not limited to mobile network services, are outside of CoinFlip’s control, and CoinCache is not responsible or liable for issues arising from them. If your mobile carrier is not participating, you will not receive a reply to your messages. Some operators may not support some services (e.g. pre-paid users may not be able to participate). Check with your carrier to confirm. 

To receive CoinCache text messages, you must be listed as an authorized user on the mobile account, a resident of the United States, and 18 years of age or older.

How to Opt-Out

You may not opt-out or cancel Essential Messages.

​

To stop receiving text messages from a specific CoinCache Optional Message program, text the keyword STOP to the longcode or shortcode for the text message program from which you no longer wish to receive messages (i.e. the number from which its text messages are being sent). You agree to receive one final message confirming that your request has been processed. If you unsubscribe from one of our Optional Message programs, you will continue to receive Essential Messages, and you may continue to receive Optional Messages from CoinCache through any other programs you have joined until you separately unsubscribe from those programs.

CoinCache may suspend or terminate your receipt of CoinCache text messages if CoinCache believes you are in breach of these Text Terms or the CoinCache Terms of Service. Your receipt of CoinCache text messages is also subject to termination in the event that your mobile telephone service terminates or lapses. CoinCache reserves the right to modify or discontinue, temporarily or permanently, all or any part of CoinCache text messages, with or without notice.

Help / Customer Care â€‹

Text the keyword HELP to the longcode or shortcode number from which you received our text message(s) to return customer care contact information. If you are experiencing any problems, please email support@coincache.co

This message program is a service of CoinCache.

Duty to Notify and Indemnify 

​

If at any time you intend to stop using the mobile telephone number that has been used to subscribe to the CoinCache’s SMS messaging program, including canceling your service plan or selling or transferring the phone number to another party, you agree that you will opt-out of receiving text messages from CoinCache by texting STOP to the longcode or shortcode for the text message program from which you no longer wish to receive messages (i.e., the number from which its text messages are being sent) prior to ending your use of the mobile telephone number. You understand and agree that your agreement to do so is a material part of these Text Terms.

 

You further agree that, if you discontinue the use of your mobile telephone number without notifying CoinCache of such change, you will be responsible for all costs (including attorneys’ fees) and liabilities incurred by CoinCache, or any party that assists in the delivery of the mobile messages, as a result of claims brought by individual(s) who are later assigned that mobile telephone number. This duty and agreement shall survive any cancellation or termination of your agreement to participate in any of CoinCache’s SMS messaging programs.

You agree that you shall indemnify, defend, and hold CoinCache harmless from any claim or liability resulting from your failure to notify us of a change in the information you have provided, including any claim or liability under the Telephone Consumer Protection Act, 47 U.S.C. § 227, et seq., or similar state and federal laws, and any regulations promulgated thereunder, resulting from us attempting to contact you at the mobile telephone number you provided.

Miscellaneous and Changes to Text Terms 

 

The failure of either party to exercise in any respect any right provided for herein will not be deemed a waiver of any further rights hereunder. Any new features, changes, updates or improvements of the Text Terms unless explicitly stated otherwise in writing. CoinCache reserves the right to change these Text Terms from time to time. Any such revision, modification, or amendment shall take effect when it is posted to CoinCache’s website. You acknowledge your responsibility to review these Text Terms from time to time and to be aware of any such changes. By continuing to participate in the SMS messaging program after any such changes, you accept these Text Terms, as modified. We may also notify you by other means, such as sending a text message to the number you used to sign-up for our text message program(s).
